Fish and chip shop boss director ban

A 72-year-old Bangor woman has been banned from being a company director for six years for her unfit conduct as head of seven Co Down take-away fish and chip shops.

The Department for the Economy has accepted a disqualification undertaking for six years from Carole Newell of Abbey Drive, in respect of her conduct as a director of JL Hot Foods Limited and Carnburn Limited.

The department has also accepted a disqualification undertaking for four years from Samuel Hugh Newell (50) of Maxwell Lane, Bangor in respect of his conduct as a Director of Carnburn Limited.

JL Hot Foods Limited operated a chain of seven take-away fish and chip shops within Co Down and entered liquidation on August 27, 2015 with liabilities to unsecured creditors of £297,441 and an estimated deficiency as regards creditors of £297,441. After taking into account the losses incurred by the shareholders of JL Hot Foods Limited the estimated total deficiency was £297,442.

Carnburn Limited operated as a licensed bar from 107 Bloomfield Road South in Bangor and also entered liquidation on August 27, 2015 with estimated total assets available for preferential creditors of £5,000, liabilities to secured creditors of £30,275, liabilities to unsecured creditors of £153,550 and an estimated deficiency as regards creditors of £178,825. After taking into account the losses incurred by members (the shareholders) of Carnburn Limited the estimated total deficiency was £178,826.

The department accepted the disqualification undertaking from Carole Newell on February 27 based on unfit conduct, which included failure to pay tax, National Insurance and VAT for the tax years 2013/14 and 2014/15.

The department accepted the disqualification undertaking from Samuel Hugh Newell on February 27 based on unfit conduct which included a failure to deliver up all company books and records.

The department has accepted 36 disqualification undertakings and the court has made five orders disqualifying directors in the financial year to date.
