John Caldwell: Two charged with claim of responsibility told they cannot associate with 35 others

Two men charged in connection with the claim of responsibility for the shooting of Detective Chief Inspector John Caldwell in Omagh in February last year have been told that they are not to associate with 35 named individuals.

Tiernan McFadden (26) of Carnhill and Caolan Brogan (24) of Bluebellhill Gardens both in Derry are charged with possessing items for use in terrorism in connection with the claim of responsibility for the shooting of Detective Chief Inspector John Caldwell which was pasted on a wall in Creggan.

Defence counsel for McFadden, Mr Stephen Mooney, said that some variations had been agreed including the fact that McFadden could now reside at two addresses.

He said his tag would also be removed but he had to present himself at the door and he was allowed to enter Creggan by an approved route.

McFadden’s curfew was also extended to 10pm but a new condition was added that the defendant was not to associate with anyone on a list of 35 individuals.

Defence solicitor for Brogan, Mr Paddy MacDermott, said his application was simpler in that it was just to extend the curfew until 10pm and he too was not to associate with any of the 35 named individuals.

Both men will appear again on May 29 for a Preliminary Enquiry.
