FORMER Derry City and Celtic footballer Patrick McCourt is to make an abuse of process application in his case.

McCourt (38) from Wheatfield Court in Muff, Co Donegal is charged with one count of sexual assault that was said to have occurred on January 30.

At Thursday's hearing, a prosecutor told the court that a report on the alleged injured party's phone was ready for the defence.

She said that the PPS had supplied an expert report on this phone but this had not been accepted by the defence who wanted its own report.

Defence solicitor Ciaran Shiels asked for a three week adjournment so that an abuse of process application could be lodged. The case was adjourned until December 8.
