Man claiming he accidentally hit ex-partner due to excitement of Tyson Fury fight remanded into custody

A MAN who claimed an injury to his former partner's mouth came about because he became excited during the Tyson Fury fight and accidentally hit her has been remanded into custody.

John McDaid (46) of Creggan Heights in Derry appeared charged with breaching his bail by being intoxicated and being in contact with the woman and a new charge of assault.

Derry Magistrate's Court heard that police were alerted by Social Services who had called out to make a welfare check and been refused entry.

Police found Mr McDaid in the property in breach of his bail the woman was upstairs in the house with a cut to her mouth.

The woman was alleged to have told police: "I invited him in and he attacked me."

The court was told that Mr McDaid had been charged in July in connection with the same alleged injured party and his bail conditions were that he does not drink and have no contact with the woman.

A police officer told the court that there was a domestic history between the pair going back to 2008.

She said that Mr McDaid said he had been with the woman all weekend and had consumed 24 cans of beer.

He told police the woman had come by her injury when he was watching the fight and got excited and waved his hand in the air accidentally striking the woman.

Bail was opposed as the officer said Mr McDaid had shown a total disregard for bail conditions, could re-offend and could influence the woman to withdraw her evidence.

Defence solicitor Paddy MacDermott said that his client denied assaulting the woman.

He said there were two "compelling reasons" why he should be released on bail one being he was the tenant of the property and that could be jeopardised if he went into custody.

Secondly he said Mr McDaid cared for his father who was seriously ill.

District Judge Barney McElholm said that there would be "no tolerance for breaches in domestic cases".

He said if Mr McDaid was that concerned about paying the rent he would have gone to work instead of drinking and if he was that concerned about his father he would not have spent the weekend drinking.

Bail was refused and the original bail was revoked McDaid was remanded in custody to appear again on November 4.
