Man (19) accused of robbing Dungannon shop armed with hammer refused bail

A 19-year-old man facing trial for robbing a corner shop in Co Tyrone armed with a hammer has been refused bail.

Xavier Jalo-Caldeirinha is currently on remand on two charges dating back to March 2019.

From Lambfield House in Dungannon, he is accused of robbing a shop in the town of cash and cigarettes and possessing a hammer in Milltown Street.

A bail application was made at Belfast Crown Court by defence barrister Craig Patton, who said that as his client's trial has now been put back due to the coronavirus crisis, he "will remain in custody for a considerable period of time at a time when custody has been recognised by the court as being more of a punishment that usual".

Prosecutor Stephen McCourt said Jalo-Caldeirinha's release was being opposed for a number of reasons, including concerns he would not turn up for a court and a risk of re-offending.

Setting out the Crown case against him, Mr McCourt said: "When he was leaving the shop, the witness said the robber nodded at him in a way to suggest he knew him."

The prosecutor confirmed there had been six previous breaches of bail, including breaching his curfew and damaging his electronic tag.

Mr Patton said there has never been any attempt while on bail to contact the witness or the shop owners.

He also said Jalo-Caldeirinha had never tried to flee the jurisdiction.

However, the bail application was refused by Judge Patrick Kinney, who said no conditions imposed would mitigate against the risks posed.
