A Dublin man will seek to have charges of falsely imprisoning and assaulting Quinn Industrial Holdings (QIH) director Kevin Lunney dismissed later this month, the Special Criminal Court has heard.

Alan O’Brien (39), with an address at Shelmalier Road, East Wall, is accused of involvement in the attack on the 50-year-old at Drumbrade, Ballinagh, Co Cavan last September.

The father-of-six was abducted close to his home in Co Fermanagh on the evening of September 17.

His leg was broken, he was doused in bleach and the letters QIH were carved into his chest during a two-and-a-half hour ordeal before he was dumped on a roadside in Co Cavan.

Prosecution lawyer Sean Guerin said Mr O'Brien's case was listed yesterday for an application under Section 4E of the Criminal Justice Act 1999 for the dismissal of a charge against an accused.

However, Mr Guerin said he was making an application to adjourn the hearing.

Defence lawyer Bernard Condon said his client was "very anxious" for the application to be heard as soon as possible.

Mr Justice Tony Hunt, sitting in the non-jury court with Judges Sarah Berkeley and Dermot Dempsey, fixed the hearing for July 29 and Mr O'Brien was remanded in custody until that date.

Also accused of the same offences are Luke O’Reilly (66), from Mullahoran Lower, Kilcogy, Co Cavan; Darren Redmond (25), from Caledon Road, East Wall, Dublin; and a third man who cannot be named for legal reasons.

Mr O’Reilly and Mr Redmond were granted High Court bail in April, despite Garda objections.

Last month the Special Criminal Court fixed January 11 2021 as the date for the trial of the four accused.
