A NOTORIOUS convicted rapist has been remanded in custody accused of failing to inform police of his living arrangements.

Eamon Foley appeared before Belfast Magistrates' Court charged with breaching the terms of a Sexual Offences Prevention Order.

The 58-year-old, of Dreenan Road in Castlederg, Co Tyrone, was arrested on Monday immediately after representing himself in an appeal against a separate conviction for not making contact with the PSNI.

He claims the notification requirements do not apply to him because the law was brought in after he was found guilty of attacking a 91-year-old woman.

He served half of a 16-year prison term imposed for raping the pensioner at her mobile home on the outskirts of the village in 1999. She died several weeks later.

In 2008 he was released from jail under strict monitoring by police.

A further 12-month sentence was imposed last year following the failure to make an annual re-notification of his name, date of birth and address to the authorities.

Foley is seeking to overturn that conviction by claiming he was under no legal obligation to comply with the condition.

Central to his case is a contention that the annual re-notification requirement within the Sexual Offences Act 2003 does not apply to him.

Foley maintains that previous legislation from 1997 includes no such condition and applies to him.

Police were waiting to arrest him as he emerged from the appeal hearing at the Royal Courts of Justice in Belfast.

He has now been charged with two offences related to an alleged failure in May to notify an address within 72 hours.

A police constable told the Magistrates' Court Foley was not at the Dreenan Road property each time he called.

"His brother who lives there says he is not there," the officer added.

Foley claimed he was being subjected to "trumped-up charges".

He told District Judge Fiona Bagnall: "I have video recordings showing me living at that address."

The accused then rejected her recommendation that he should see a lawyer.

"I will not be getting legal advice because I don't work with solicitors," he insisted.

Remanding him in custody, Mrs Bagnall cited his alleged failure to notify police.

Foley is expected to appear again by video-link in two days time.
