THE family of a man shot dead in Dublin by the UVF are to sue the chief constable amid claims of collusion.

Martin Doherty (35) was killed by UVF men attempting to plant a bomb in Widow Scallan's pub on Pearse Street, where a fundraiser for republican prisoners was being held, on May 21, 1994.

The gun used to murder Mr Doherty, a doorman at the pub, was used by the UVF in three previous murders and three attempted murders.

Belfast lawyer Kevin Winters, who is acting for the Doherty family, said the bomb attack and the murder could have been prevented if RUC Special Branch had provided information to gardaí.

The Doherty family are to sue the chief constable for negligence amid claims of collusion.

Mr Winters, of KRW LAW LLP, said: "If Martin Doherty's death could have been prevented but was not through collusion because of State Security Forces and paramilitary groups then this demands accountability in compliance with human rights standards".

The Doherty family have also made a complaint to the Police Ombudsman about alleged RUC misconduct.
