Police-assault case against doctor 'might end in judicial review'

THE case against a doctor from Belfast who is charged with assaulting police, resisting police and disorderly behaviour on December 13 last may end in a judicial review, Derry Magistrates Court has heard.

A solicitor for Eireann Kerr (31), of Marlborough Park South in Belfast, told District Judge Barney McElholm that he may have to apply for a judicial review over a decision to proceed with the case.

Defence solicitor Derwin Harvey said an issue around toxicology reports by both the defence and prosecution would have to be resolved "either in this court or by way of judicial review".

The judge said that he would set a date for contest on October 24 but in the meantime he wanted the prosecution to clarify whether they were challenging the defence report.

He also told Mr Harvey he was entitled to go to another court if that was necessary.
